At Principal, we are committed to respecting your privacy. This Privacy Statement is designed to
describe to you the basis of the personal data that we collect from you or that is provided by you as part of our recruitment process. The notice explains how your personal information may be used, disclosed and how you can get access to this information. When you apply for a job posted by us , the information that we collect, or you provide is used to determine whether you are fit for the current and future roles at our company. If at any point, you would like to us to remove the information that we have collected from you, just let us know. We reserve the right in our sole discretion to change, modify, add or delete portions of this Privacy Notice at any time. Please carefully review Data Privacy Statement.
DATA PRIVACY STATEMENT
All applicants ("you", "your" or "yours") must read the following terms and conditions thoroughly and accept such terms and conditions before applying for a position in Principal Financial Group and/or its affiliates (“Principal”, “the Group”, “we’, “us” or “our”)
IMPORTANT: No personal data will be submitted to Principal if you do not consent to the following terms and conditions.
PURPOSE
The personal data you provide to us in this application will be used to process your application for a position in Principal Financial Group and/or its affiliates. If you fail to supply data requested in this form, the Group may not be able to process your application. Should you be offered an employment eventually, the personal data collected in this form will be used for human resource management purpose. The personal data that we have collected may be transferred to any member company(ies) within the Group and other third party companies engaged to perform any human resource function on behalf of any member company(ies) within the Group. As a result, the personal data may be transferred outside Thailand.
TYPES OF INFORMATION TO BE COLLECTED
In order to be considered for application for employment, you will be asked to provide us with personal information. Examples of the type of information we may collect include your legal name, residential address, contact details, resume, education background, employment history, referees and results of employment checks.
If you choose not to provide any of the information requested, we may be unable to send you information, fully process your application or properly consider you for employment opportunity. When providing us with the information, you represent that such information is accurate, complete, up to date and true and is supplied for the sole purpose of application for employment.
You may also be invited to supply some diversity information as part of your profile, including but not limited to your age range, gender or physical needs. Provision of this information is voluntary. This information, if you decide to provide it, will only be used for any special requirements as part of the recruitment process or your ongoing employment.
PROVISION OF ANOTHER PERSON’S DATA
If you provide to us personal data about another person, you should obtain prior consent of that person and provide that person with a copy of this Statement, and, in particular, inform him/her how his/her personal data may be used.
HANDLING OF PERSONAL DATA
Information provided by you in this form will be kept strictly confidential. Your application may be considered for other suitable positions in the Group.
RIGHTS OF THE DATA SUBJECT
Under certain circumstances, you have rights under PDPA in relation to your personal information:
• Right to withdraw consent at any time: This applies where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.
• Request access to your personal data: This enables you to request a copy of the personal data we hold about you and to check that it is accurate and that we are processing it lawfully. This is not, however, an absolute right, and the interests of other individuals may restrict your right of access. For additional copies requested, we may charge a reasonable fee based on administrative costs.
• Request correction of your personal data: This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
• Request transfer of your personal data: This enables you to request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
• Request erasure of your personal data: This enables you to ask us to delete or remove personal data where there is no lawful basis for us continuing to process it. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
• Request restriction of processing: This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data's accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
• Object to processing of your personal data: This enables you to object to processing of your personal data where we are relying on a legitimate interest and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. We will provide you with appropriate choices to opt-in or optout as set out above in our Policy.
• Make a complaint: You have the right to make a complaint at any time to the relevant data protection supervisory authority. We would, however, appreciate the chance to deal with your concerns before you approach your supervisory authority.
We require that your request be in writing to our Head of Human Resources. In addition, we may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response. We try to respond to all legitimate requests within a reasonable period and not exceeding the time specified by law.
In the event that you request us to delete, destroy, limit the data processing, suspend, transform your personal information into a form that does not personally identify the owner of the personal information or withdraw your consent, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.
You will not have to pay a fee to access your personal data (or to exercise any of the other rights).
However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive.
Alternatively, we may refuse to comply with your request in these circumstances.
GOVERNING LAW AND JURISDICTION
These terms and conditions and the rights and obligations contained hereunder shall be governed by and construed in accordance with the laws of Thailand. The courts of Thailand shall have the exclusive jurisdiction to hear and determine any suit or proceeding, and to settle any dispute or claim, which may arise out of or in connection with these terms and conditions and the parties hereby irrevocably submit.
